4. Services Offered

• FYWM App (B2C): wine discovery, AR shelf scanning, personalised wine matching, and wine availability mapping.
• WineDesk (B2B): winery platform to showcase wines, share brand stories, and access aggregated consumer insights.

All services are subject to availability and may be modified, updated, or discontinued at our discretion.

5. Winery Responsibilities (WineDesk Users)

Wineries using WineDesk agree to:

• Provide accurate and lawful business and product information;
• Ensure compliance with local laws, including alcohol advertising and labelling rules;
• Not upload content that infringes intellectual property rights of third parties;
• Acknowledge that crowdsourced data provided by consumers (e.g., availability scans) may not always be accurate.

Find Your Wine Match is not responsible for inaccurate, misleading, or unlawful content uploaded by wineries.

6. User-Generated Data (Consumers)

Consumers contributing data (e.g., wine availability scans or location updates) retain ownership of their contributions. By submitting data, users grant Find Your Wine Match a non-exclusive, worldwide, royalty-free licence to use, anonymise, aggregate, and share such data with wineries and partners for insights and analytics.

We may remove user submissions that violate these Terms.

7. Limitation of Liability

To the maximum extent permitted by law, Find Your Wine Match and our directors, officers, agents, and affiliates will not be liable for:

• Any damages, losses, or liabilities resulting from use of our Services;
• Service interruptions, errors, or technical failures;
• Inaccuracies in crowdsourced content or winery-provided information;
• Loss of data, business opportunities, or profits.

Our Services are provided "as is" and "as available", without guarantees of uninterrupted access or error-free operation.

8. Links to Third-Party Websites

Our Site and Services may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of these third parties. It is your responsibility to review their terms and privacy policies.

9. Subscriptions, Cancellations & Refunds

Some Services, including WineDesk, operate on a subscription basis.

Cancellation: You may cancel at any time through your account settings or by contacting info@findyourwinematch.com.

10. Termination of Services

We may suspend or terminate access to any account if:

• You breach these Terms;
• You provide false, misleading, or unlawful information;
• You misuse or attempt to disrupt the Services.

Termination does not affect any rights or obligations accrued before termination.
